Privacy Policy
1. Personal Data
We, FORIZS SLANY Rechtsanwälte GmbH, collect, process and use your personal data only with your consent, on the basis of a mandate or appointment, for the purposes agreed with you, or where another legal basis for processing exists in accordance with the General Data Protection Regulation (GDPR). In doing so, we comply with all applicable data protection and civil law requirements.
We collect only such personal data as is necessary for the provision and administration of our legal services or as you voluntarily provide to us.
Personal data means any information relating to an identified or identifiable natural person, including, for example, name, address, e-mail address, telephone number, date of birth, age, gender, social security number, video recordings, photographs and voice recordings, as well as biometric data such as fingerprints. This may also include special categories of personal data, such as health data, as well as data relating to criminal proceedings.
2. Access, Rectification and Erasure
As a client or, more generally, as a data subject, you have – subject to our professional duty of confidentiality – the right at any time to obtain information about the personal data stored concerning you, its source and recipients, and the purposes for which it is processed. You also have the right to rectification, data portability, objection, restriction of processing and, where applicable, erasure of personal data that is inaccurate or has been processed unlawfully.
Please inform us if any of your personal data changes.
You may withdraw your consent to the processing of your personal data at any time. Requests for access, erasure, rectification, objection and/or data portability may be submitted to the law firm at the address specified in section 10 of this Privacy Policy. The right to data portability applies insofar as its exercise does not involve disproportionate effort.
If you believe that our processing of your personal data infringes applicable data protection law or otherwise violates your data protection rights, you have the right to lodge a complaint with the competent supervisory authority. In Austria, the competent authority is the Austrian Data Protection Authority (Österreichische Datenschutzbehörde).
3. Data Security
We protect your personal data by means of appropriate organisational and technical measures. These measures are designed in particular to protect your data against unauthorised, unlawful or accidental access, processing, loss, use or manipulation.
Despite our efforts to maintain an appropriately high level of security, it cannot be completely ruled out that information transmitted to us via the internet may be accessed or used by third parties.
Please therefore note that we cannot accept liability for the disclosure of information resulting from transmission errors not caused by us and/or unauthorised access by third parties, such as attacks on e-mail accounts or telephones or the interception of fax transmissions.
4. Use of Data
We process the data provided to us only for the purposes covered by our engagement agreement, your consent or another legal basis in accordance with the GDPR. This does not apply to the use of anonymised data for statistical purposes.
5. Disclosure of Data to Third Parties
In order to fulfil your instructions, it may be necessary to disclose your personal data to third parties, such as opposing parties, substitute lawyers, insurance companies, service providers engaged by us, courts or public authorities. Your personal data will be disclosed only on a lawful basis under the GDPR, in particular where this is necessary for the performance of your instructions or where you have given your prior consent.
We also inform you that, in the course of providing legal representation and advice, we may regularly obtain factual and case-related information concerning you from third parties.
Some recipients of your personal data may be located outside your country or may process your personal data there. The level of data protection in other countries may differ from that in Austria or the European Economic Area. We transfer personal data to third countries only where the requirements of the GDPR are met, in particular where the European Commission has adopted an adequacy decision or where appropriate safeguards (in particular the Standard Contractual Clauses) are in place.
6. Notification of Personal Data Breaches
We endeavour to ensure that personal data breaches are identified at an early stage and, where required by law, reported without undue delay to you and/or the competent supervisory authority, taking into account the categories of personal data affected.
7. Data Retention
We retain personal data only for as long as necessary to fulfil our contractual and statutory obligations and to establish, exercise or defend potential legal claims.
8. Cookies
This website does not use cookies and does not integrate any tracking, analytics or marketing services or third-party content. No information is stored on or read from your device beyond what is required to display this website. Technically necessary data is processed solely in the course of operating the server (see section 9).
9. Server Log Files
For the purpose of optimising this website in terms of system performance and usability and providing useful information about our services, the website provider automatically collects and stores information in so-called server log files, which your browser automatically transmits. This information may include your Internet Protocol address (IP address), browser type, language settings, operating system, referrer URL, internet service provider and the date and time of access.
This data is not combined with other sources of personal data. We reserve the right to review this information retrospectively if we become aware of specific indications of unlawful use.
